After McNeil’s continued appeal on multiple grounds and a jury order, the US 9th Circuit Court of Appeals overturned his conviction. California responded by appealing to the Supreme Court, which overturned the judgment of the 9th Circuit. As a result, the case was remanded to the 9th Circuit Court for reconsideration.

On March 29, 2005, the 9th Circuit issued an opinion in favor of the state and reinstating McNeil’s original conviction. The Court relied on the information and guidance of the SCOTUS opinion in making its decision.

McNeil earned the rank of Sergeant while serving in the United States Marine Corps at Camp Pendleton. She also won the US Army Physique Championship twice in the late 1980s.
